State Police Charge Somers Man with Promoting Obscene Sexual Performance of a Child

The New York State Police Bureau of Criminal Investigation (BCI) at Somers, in coordination with the New York State Police Troop K Computer Crimes Unit (CCU), has arrested Andrew J. Giannetta 34, of Somers, NY, following a long-term Internet Crimes Against Children (ICAC) investigation.

In February 2024, the National Center for Missing and Exploited Children (NCMEC) submitted a CyberTipline report to the New York State Police regarding suspected child sexual exploitation material being shared through a social media platform. The investigation identified Giannetta as the suspect, leading to the execution of a search warrant at his residence. Multiple electronic devices were seized for forensic analysis.

Following a review of the evidence and consultation with the Westchester County District Attorney’s Office, Giannetta was arrested on November 26, 2025, and charged with the following:

• Two (2) counts of Promoting an Obscene Sexual Performance by a Child Less Than 17 Years of Age, Class D felonies.

Giannetta was arraigned before the Somers Justice Court and released on his own recognizance. He is scheduled to reappear in court on February 2, 2026, at 5:30 p.m.
