Sibling sentenced to 25 years to life in prison for fatally stabbing brother

Queens District Attorney Melinda Katz announced that Henrry Gutierrez was sentenced to 25 years to life in prison for fatally stabbing his 52-year-old brother in July 2022. The incident occurred during an argument inside a multi-unit Jamaica residence where the two men lived on separate floors.

District Attorney Katz said: “This is an extraordinary family tragedy. One brother is dead, and another will spend 25 years to life behind bars for his gruesome killing.”

Gutierrez, 32, of Jamaica Avenue in Jamaica, was found guilty of murder in the second degree and criminal possession of a weapon in the fourth degree on February 10 following a jury trial that began on February 4. Justice Michael Aloise, who presided at trial, sentenced the defendant today to 25 years to life in prison.

According to the charges and trial testimony, the defendant lived on the third floor of a multi-family home on Jamaica Avenue. On July 12, 2022, at approximately 6:20 p.m., Henrry Gutierrez entered a second-floor apartment in the building that was occupied by his 52-year-old brother Oscar Gutierrez, as well as Henrry Gutierrez’s ex-girlfriend and her son.

The defendant retrieved a knife from a kitchen drawer, grabbed a hammer and yelled for his brother to come out of his room. When the victim came out, the defendant waved the hammer at him at which point the victim picked up a broom handle and swung it at the defendant. The defendant then stabbed his brother with the kitchen knife 14 times.

Family members inside the home called the police, but the defendant fled the scene before police arrived. The murder weapon, the hammer and the broom stick were recovered at the scene.

The victim was transported to a local hospital where he was pronounced dead.
