December 31 is the last day for tenants to pay up all rent or the landlord can file for eviction starting January 1. The court opens for holdover and non-payment proceedings starting tomorrow for NYC. This is for both residential and commercial tenants. More than 150,000 proceedings were received this week in Queens housing court for the December 31 deadline for tenants. If nonpayment case was filed between 06/22/20 - 11/03/20, there is 60 days to answer. If it was filed after 11/03/20, there is 10 days to answer. The eviction process depends on the legal ramifications between both tenants and lawyers representation in courts.
