Driver charged in Flushing crash that killed 1 year old boy in stroller

A motorist in Queens has been indicted on charges of manslaughter and driving while intoxicated in an incident that resulted in the tragic death of a 1-year-old child in a stroller.

The incident occurred on Sunday morning at the intersection of Murray Street and 32nd Avenue in Flushing.

According to prosecutors, 57-year-old Elvin Rivera failed to stop at a sign while driving his white Chevrolet Silverado pickup, sped into the intersection, and collided with the stroller that was being pushed by the child's nanny.

The young boy succumbed to his injuries at the hospital. The nanny also endured pain and injuries to her right arm.

Rivera remained at the scene. Officials report that he did not pass a field sobriety test, and a drug screening conducted at the site revealed the presence of cocaine and THC in his system. Rivera currently has an ongoing DWI case in the Bronx dating back to April 2026.

"This tragic loss of a little one was entirely preventable," stated Queens District Attorney Melinda Katz. "As alleged, Elvin Rivera drove his pickup truck on a Sunday morning while impaired by both cocaine and THC. He then carelessly disregarded a stop sign, sped through the intersection, and crashed into a 1-year-old boy who was being pushed in a stroller, resulting in the child's death."

He was arraigned on counts of second-degree manslaughter, second-degree vehicular manslaughter, second-degree assault, operating a motor vehicle under the influence of narcotics/alcohol, driving while ability impaired by the combined influence of drugs or alcohol and any drug, reckless driving, operating as an unlicensed driver, and related offenses.

If convicted of the most serious charge, he could face a potential sentence of five to fifteen years in prison.
