Cuomo extends eviction mortarium to January 1

For tenants in NY including NYC, landlords will have to wait until January 1 to file eviction for either holdover or non-payment. However, tenants are obligated to pay the rent despite the pandemic. For landlords filing for eviction before the pandemic, the expiration date is October 1.

From the governor's office, protesters took their cancel rent and homeless camps to governor's office and home were one of the reason for date change. Landlords especially small home owners are facing mortgage crisis and property taxes that start accruing penalty interest in two weeks before lien is placed.

Cuomo also is giving headache to NYC mayor to open more homeless shelters instead of homeless encampments all over. Residents have complained of homeless encampments with sidewalks used as toilets unable for people to walk. Cuomo quoted, ?Not only is a homeless encampment a violation of that person?s dignity, it?s a public health threat now.?

Also, if tenants have not paid the rent, landlords can file with their lawyers to seek rent and can use legal process to collect including bank account freeze if approved by the court.
